  2. HR is not a function which can be studied in a short period of time but it is to be experienced. Each experience or each situation you face will be a value addition for you. Inorder to be an expert in HR you have to gather as much information as you can about how to build up relationship. You should be able to enforce all basic rules applicable to your establishment. For that a sound knowledge about the current Labour Laws is very important. Take advice from seniors and HR Professionals. Follow good HR websites like citehr.com where you can find advices of professionals.

    All the best.

  5. I don't think that you need to acquire any degree in HR to manage the people in your own firm. Even HR can not be taught but it should be experienced and for that a University degree will not be sufficient. It is the consolidation of different experiences that you gain from different situations that make you a polished and trimmed HR person. Needless to say that in order to get a job in HR the degree shall be the main measuring stick. And that is for an opening; to grow from the position it is not considered.

There is no professional and non professional approaches for HR. If the class room lectures give you a lot of 'professional' techniques to HR, you may fail to practice it in real life situations. Some times you may find a conventional and new generation approach to HR; the former being centred on traditional IR approach and the latter with some sophisticated training and development approaches. We call the latter as professional HR which claims to realise Personnel at work as wealth of the establishment and claims that welfare of the employees is the sole objective of HR. But what is the reality? Do all new generation HRs aim at employee welfare? Do you think that giving soft skill training to a welder or machinist will bring about better employee employer relationship?. I do not believe so.

  7. You have enough opportunities to come. Wait, good positions will come, do not get panic. In the meanwhile get in to Labour Laws and IR matters by referring case laws and update your knowledge in it. I believe that a good HR man should be good in Laws.

    All the best.

  11. Dear Sir,
Which is record is mandatory in new establishment according Gratuity act 1972 & Bonus act after five year...... any notification give in labour deptt. by us..pls. tel me .. send u r valuebal reply in my id r.chandra@live.in

    ReplyDelete
  12. Your question is not clear. For a new establishment Payment of Bonus Act will not apply till the establishment makes profit. Therefore, the relevant record for that means Profit & Loss account and Balance Sheet.
Payment of Gratuity becomes due when an employee leaves after serving for at least five years. Therefore, the question of payment of Gratuity does not arise for five years. However, if an employee dies while in service (not necessarily be while on duty) his dependent should be paid gratuity even if the deceased employee had not put in five years of service. Therefore, immediately when an employee completes one year of service, you have to collect nomination in form F. Similarly, you have to provide for gratuity from the first year itself.

  13. Hello sir,

Im MBA(hr)fresher having good communication skills, and having great knowledge in labour laws & buisness law, but my problem is that im getting mere no of jobs from consultancy, but im looking for job role in manufacturing and IT industry so that i can fulfill my thrust of my knowledge...... so wat way should i adopt to reach my current target

    ReplyDelete
  14. There are openings in manufacturing and IT as well. Wait and you will get a job of your choice. In the meantime, update your knowledge in labour law because once you think that you have acquired 'great knowledge' in law, you will not update it. As you know law is some thing which will become obsolete very often. Therefore, gather as many information as you can and update your knowledge with relevant cases and studies.

  15. dear sir,

I want a clarification reg. Over time. In our company while computing over time amount Basic+D.A+V.D.A are considered.

According to Factory act 1948 Sec-59, it explicittly states that "Basic wages plus such allowances , including the cash euivalent of the advantage accuring through concessaional sale to workers of foodgrains and other articles"

My query is even though we are having HRA, Amenities allowance, Special Allowance etc as wage components, we are not considered the allowance for computing the OVer Time. whether is a contravention against factory act.

Please brief me or send mail to sam_ben2005@yahoo.com

  17. Trade Union and its membership and enquiry are two different things. His change in membership has nothing to do with the enquiry.

Of late, we have declared lock out for unionized cadre. due to inevitable production schedule, the management propsed to complete the production with the assistance of non-unionized cadre.

    kindly suggest,

    1. Is it advisable to start production, while the company is in lock out.
    2. Can the unionized member justified that is is ill-legal lock out, since production activities is under process
